1. About Nautical Immigration

At Nautical Immigration ("us", "we", or "our"), we value your privacy and are committed to protecting your personal data. This Privacy Policy informs you of our policies regarding the collection, use, and disclosure of personal data when you use our website (the "Service") and the choices you have associated with that data.

2. Our Commitment to privacy

This Policy outlines our commitment to the privacy of all visitors to the Nautical Immigration (NI) websites and services, and fully describes when, why and how we collect personal information in a secure manner. Your use of NI websites and services is subject to this Policy. In addition, your use of our sites and associated services constitutes your acceptance of these terms. If our Policy changes in the future, we will post the revised Policy on our websites and update the "Last Updated" date at the top of this Policy. If the changes are significant, you will be notified via email and/or a prominent notice on our website. We encourage you to review this Policy periodically to be informed of how we use your personal information. If you disagree with any changes to this Policy, you will need to stop using this website and deactivate your account(s), if applicable, as outlined below.

We may offer you the ability to connect with our websites or use our services and tools using a mobile device via a mobile optimized website. The provisions of this Policy apply to all such mobile access and use of mobile devices. This Policy will be referenced by all such mobile optimized websites.

3. Collection and Processing of Personal Information

3.1 Personal information that we collect

We solely gather essential personal information required to conduct our business, deliver the service(s) you asked for, and update you about the latest Canadian immigration

The personal information we gather directly from you may comprise the following for Nautical Immigration:

  • If you indicate a desire to learn more about our services, seek client support, or use features like "Contact Us," we typically ask for your contact details, including your name, email address, phone number, and country of residence. By providing us with your contact information online, you will only receive communication from us related to Canadian immigration, settlement in Canada, and studying in Canada.

  • If you complete and submit one or more of our Eligibility Questionnaires and/or Express Entry CRS Calculator on our website, we typically request certain personal information from you, depending on the questionnaire(s). This may include your name, email address, phone number, age, nationality, country of residence, immigration status, relationship and marital status, parental status, financial status, employment history, business ownership, and education background. Additionally, you have the option to provide your resume or other personal information relevant to assessing your eligibility for Canadian immigration. We may subsequently send follow-up emails to the email address you provided regarding your Canadian immigration inquiry unless you have unsubscribed or opted-out from receiving such emails. We will use your personal information solely for the purpose of evaluating your potential to immigrate to Canada based on the current immigration selection criteria, and we will not sell your personal information to any third-party without your explicit consent

  • If you register an account to access one or more of our online services, such as the Canadian Immigration Form, on our websites, we may request that you provide a username, email address, and password.

  • When you use and engage with our websites, we automatically gather log files and other data about your device and your website activity using cookies, web beacons, or comparable technologies. This data may include IP addresses or other identifiers that may be classified as personal information (refer to the "Device and usage data" section below).

  • If you would like to retain our services and use our Payment Options, we may ask you to provide your name, email address, and payment information.

3.2 Personal information of children

In order to create an account with the Nautical Immigration, you must be 18 years old or older. We do not knowingly collect any personal information from individuals under the age of 18. As such, those under 18 should refrain from using the NI websites or sharing any personal information with us. We advise parents and legal guardians to supervise their children's internet activities. If you suspect that a child under 18 has provided us with personal information, please send us an email at [insert email address].

3.3 Device and usage data

3.3.1 Log files

We utilize standard information-gathering tools, such as log files, cookies, web beacons, and similar technologies to automatically acquire information, which may involve personal details, from your computer or mobile device when you navigate our websites or interact with emails that we send to you.

Like most websites, we obtain specific data automatically through log files. This data may consist of your Internet Protocol (IP) address (or proxy server), identification numbers for your device and applications, your location, browser type, your mobile carrier and/or Internet service provider, the pages and files you accessed, your searches, your system configuration and operating system information, and date/time stamps connected with your usage.

This data is collected to conform with data contracts, treaties, national laws, and regulations, evaluate general trends to assist us in providing and improving our websites, and to safeguard their security and continuous proper functioning. As part of the NI’s security features, we also acquire IP addresses from users when they sign into our services.

3.3.2 Cookies, web beacons, and other tracking technologies

To collect information about your usage of our websites and interaction with our emails, we use cookies and similar technologies like web beacons, tags, and Javascript. Prior to placing a cookie on your computer or device, we will always ask for your consent. During your visit to our websites, our servers or an authorized third party may place a cookie on your browser. Cookies can collect information, including personal information, about your online activities over time and across different sites. These cookies help us prevent bots from misusing our websites and limit account login information sharing.

We use both session-based and persistent cookies. Session cookies exist only during one session and disappear from your computer or device when you close your browser software or turn off your computer. Persistent cookies, on the other hand, remain on your computer or device even after you close your browser or turn off your computer or device. You can control the use of cookies at the individual browser level, but disabling cookies may limit your use of certain features or functions on our websites or services. If you previously opted-in and now wish to opt-out of any given type of cookie tracking, including Google Analytics, please use the specific opt-out mechanism indicated in the "Opt-in and Do Not Track Feature" section.

In addition to cookies, we also use web beacons on our websites. For instance, we may place web beacons in notification emails that notify us when you click on a link in the email that directs you to one of our websites. These tracking technologies operate and improve our websites and email communications and track the clicking of links or opening of emails. All cookies placed by nauticalimmigration.com expire after 12 months.

We value your privacy and are committed to protecting your personal information.

3.3.3 Opt-in and Do Not Track Features

You have the option to manage your cookies at the individual browser level or use the opt-out tool provided to opt-in or opt-out of the collection of device and usage data. However, please note that if you choose to block or delete cookies and similar technologies used on our websites, you may not be able to fully utilize all features available on our websites.

Although some internet browsers offer a "Do Not Track" or "DNT" option, which allows you to inform websites that you do not want your online activities tracked, these features are not yet standardized and have not been adopted by industry groups, technology companies, or regulators. Therefore, our websites are not currently configured to respond to browsers' "Do Not Track" signals as there is no formal "Do Not Track" standard in place.

3.3.4 Social Media Features

Our websites offer Social Media Features such as the Facebook "like" button, Twitter "Tweet" button, and other sharing widgets. These features may give you the option to share information about your website activities on a profile page provided by a third-party social media network to share with others within your network. The Social Media Features may be hosted by the respective social media network or hosted directly on our website.

If the Social Media Features are hosted by the social media network, they may receive information from your IP address that you have visited our website. If you are logged into your social media account, the respective social media network may link your visit to our website with your social media profile.

The privacy policies of the companies providing the Social Media Features govern your interactions with these features.

3.3.5 Online behavioural advertising and use of advertisers

We have partnered with a third-party ad network to manage the advertising on our website as well as other sites. This ad network uses cookies and web beacons to collect non-personal information about your activities across different websites in order to provide targeted advertising based on your interests, which is referred to as online behavioral advertising. If you do not want this information to be used for the purpose of serving you targeted ads, you can opt-out by using the specific opt-out mechanism as indicated earlier in the "Opt-in and Do Not Track Feature" section. Please note that this opt-out does not mean you will no longer receive any ads, but rather generic ads instead of targeted ones.

3.4 Purposes for which we process personal information and the legal basis on which we rely

  • We process your personal information for various purposes, including providing our services, managing user registrations, handling support requests, improving our websites, sending communications, and complying with legal obligations.

  • We process your personal information based on our legitimate interests, the performance of a contract with you, and compliance with applicable laws and regulations.

  • If you do not provide the necessary personal information, we may not be able to perform our contract with you.

  • Anonymized or de-identified data is not subject to this policy.

4. Third Parties and International Transfers

We may collect, transfer, and store your personal information in Canada. We will take reasonable measures to ensure that your personal information is protected, regardless of its location.

As part of providing our services, we may transfer your personal information to non-affiliated third parties, such as IT and system administration and hosting providers, research and analytics companies, marketing agencies, account management firms, technical operations teams, credit card processors, and email service providers. These third parties are bound by agreements that prohibit them from using or disclosing your personal information for any purpose other than processing, and they are required to implement appropriate security measures to safeguard your information. The names, addresses, and contact information of our contracted service providers are listed below.

We do not sell or rent your personal information to non-affiliated third parties, except as permitted by law or as outlined in this Policy. However, if we sell all or substantially all of our business or undergo a similar transaction, we may transfer or disclose your personal information to a purchaser or prospective purchaser, who may collect, use, and disclose your information for the purposes of evaluating the transaction or managing the acquired business.

Please note that the collection, use, and disclosure of your personal information as described in this Policy may involve transferring your information to jurisdictions outside of your country of residence that do not have equivalent laws and regulations regarding personally identifiable information. For example, this may occur if one of our service providers is located in a country outside of your home country. If this happens, we will ensure that the recipient of your information provides an adequate level of protection by entering into standard contractual clauses approved by the European Commission or by obtaining your prior consent to the international transfer of your data. We take your privacy seriously and will continue to take all necessary measures to protect your personal information.

5. Retention of personal information

We understand the importance of retaining your personal information only for as long as it is necessary to fulfill the purpose for which it was collected or as required by law. Therefore, we follow a strict retention policy to ensure that we keep your personal information only for the appropriate length of time.

Our determination of the appropriate retention period for your personal information takes into account various factors, including the nature and sensitivity of the information, the potential risks of unauthorized use or disclosure, and whether we can achieve the processing purposes by other means.

Once the retention period has expired, we will securely delete your personal information. In the event that we are unable to delete the information completely from our systems due to technical reasons, we will take appropriate measures to prevent any further use of the data and inform you accordingly.

For instance, if you contest the accuracy of your personal information, or if you object to our processing of it, and we do not have any legitimate grounds that override your objection. It is important to note that this request alone does not halt our storage of your personal information.

6.6 Right to portability

If we process your personal information through automated means, either based on your consent or an agreement, you have the right to request a copy of your personal information for transfer to yourself or another party. This right is limited to the personal information you have provided to us.

You have the right to opt out of being subject to a decision that is solely based on automated processing, including profiling, which produces legal effects ("Automated Decision-Making").

Currently, our websites employ Automated Decision-Making in the Eligibility Questionnaires and the Express Entry CRS Calculator. The Eligibility Questionnaires use the results of Automated Decision-Making to assist us in determining your eligibility for Canadian immigration based on the information you provide. Similarly, the Express Entry CRS Calculator uses Automated Decision-Making to evaluate your score based on the CRS points system utilized by Immigration, Refugees and Citizenship Canada (IRCC), and the information you provide.

If you prefer not to be subject to Automated Decision-Making, kindly refrain from utilizing the Eligibility Questionnaires and the Express Entry CRS Calculator.

6.8 Consent withdrawal

If we rely on your consent for the collection, processing, and sharing of your personal information, you have the right to withdraw your consent at any time. Such withdrawal does not affect the legality of any processing based on your consent before its withdrawal.

6.9 Right to non discrimination

As a resident of California, please note that we will not engage in any discriminatory behavior against you for exercising your rights under the California Consumer Privacy Act (CCPA). This includes your right to access and right to erasure. We will not deny you services, provide you with a different level or quality of services, or suggest that you may receive a different price or rate for services, unless permitted by the CCPA. This also includes charging different prices or rates for services, including through granting discounts or other benefits, or imposing penalties.

6.10 Authorized agent

As a resident of California, you have the option to use an authorized agent to exercise your privacy-related requests and rights on your behalf. If you choose to do so, your authorized agent must provide a power of attorney or a notarized statement signed by you appointing them for this purpose. If the request is submitted by mail, the power of attorney or notarized statement must be included. If the request is submitted online, a copy of the power of attorney or the original notarized statement must be mailed to us.
